Terms and Conditions Daphne’s Schilderwerken

Daphne’s Schilderwerken, located in Hoorn at Kleine Havensteeg 3, 1621 AZ, registered with the Chamber of Commerce under number 66485517, applies the following terms and conditions.

1. General

These terms apply to all quotes, agreements and work performed by Daphne’s Schilderwerken.

2. Quotes and Agreements

All quotes are non-binding and valid for 30 days. An agreement is established after written confirmation by the client or verbal approval followed by commencement of work.

3. Execution of Work

Daphne’s Schilderwerken will perform work according to professional standards and common guidelines within the painting industry.

4. Liability and Damage

Daphne’s Schilderwerken is not liable for any damage resulting from:

Causes beyond our control, such as weather conditions, substrate problems or building defects.
Use of materials supplied by the client.
Work by third parties that affects the painting work.

The maximum liability of Daphne’s Schilderwerken is at all times limited to the quote amount for the relevant work. Compensation can never exceed the price or value of the quote amount.

5. Warranty

The warranty on materials used lies with the relevant supplier and Daphne’s Schilderwerken acts as an intermediary in case of defects.

No warranty is provided in the following cases:

When the client chooses to use their own materials.
If an external specialist concludes that the painting work has been affected by work from another painter or by the substrate.
When there are extreme weather conditions or insufficient maintenance after delivery.
When another party (business or private) performs work on Daphne’s Schilderwerken’s painting work without consultation.

6. Payment

Invoices must be paid within 14 days of the invoice date, unless otherwise agreed.

7. Cancellation and Changes

In case of cancellation within 7 days before the start of work, the client owes 30% of the quote amount. Changes to the assignment may lead to adjustment of the price and schedule.

8. Force Majeure

In case of force majeure, such as extreme weather conditions or unforeseen situations that make execution impossible, Daphne’s Schilderwerken reserves the right to suspend or cancel the work without being liable for any damage.

9. Applicable Law

Dutch law applies to all agreements. Disputes will be submitted to the competent court in the district where Daphne’s Schilderwerken is located.
